Can I buy handgun if I’m 18 but I’m in the military?

January 27th, 2010 by eranio

I read the gun laws in California and they say you cannot own a handgun at 18. However, if I’m in the military, I am still using firearms so it shouldn’t matter if I owned a handgun. Should it?

Being in the military has nothing to do with the state’s law. Your use of firearms is on a Federal facility where state laws don’t normally apply, and you don’t on the firearms you use.

State to state it is different. You need to get out the book and find out. Like Colorado you do not have to wait the 7 days. You can walk out of the store with it. Nebraska you need a permit to purchase. Check the laws for your state. Check the military clauses.

    There are military clauses.

Nope. State law dictates laws concerning firearms purchases. Military service has no bearing on that.

The way it worked when I served, was you could have a hand gun are rifle, but it was kept in the arms room. You could sign it out if you were going hunting are shooting on the range. A military post does not fall under state law. That being said I don’t think the state would sell you one anyway. Talk to a J.A.G. officer. They can give you the straight poop.

No, the all-knowing government has determined that you aren’t trustworthy with small firearms, because of your age. Never mind that you may be issued an M9. This is one of those "reasonable gun control measures" that show the philosophical basis for much of the far left, who are innately elitist in their philosophy. They are worth safeguarding; you are not. Remember that at the polls.

    No you cannot.

Everyone is right. Unless the state law specifically states that military service waives the other requirements for purchasing a handgun then you have to wait until you are 21. It sucks, but the three years go by fast.

Federal law: 18 to own a long gun, 21 for a pistol.
Being in the military is no help in this case.
