Is purchasing an assault rifle allowed in United States?

March 11th, 2010 by eranio

I’m an 18 year old guy and a citizen of the United States. I’m really interested in guns but unfortunately never owned one. I’m perfectly sane, so please don’t try to change my mind. I really like an MP-5 but are we allowed to purchase one?

Yeah of course you can buy one as long as you can kill Osama Bin Laden and deliver his head to Barack Obama

You wouldn’t be allowed to purchase a true MP-5 now, because you’re under 21. I say a true MP-5, meaning the submachine gun, to distinguish it from a semi-automatic-only copy. There is a process by which you can buy one, IF you live in a state which allows ownership of Class III firearms as defined by the1934 National Firearms Act. You will need to contact the Bureau of Alcohol, Tobacco, Firearms, and Explosives for the details, but they include getting your local chief of police or county sheriff to sign the application and paying a $200 fee for the transfer tax stamp. And, since you’d only be able to buy a civilian-legal MP5 made before May 1986, the supply is limited and the price will be equal to that of a decent used car or more.

As a civilian you may purchase semi-auto versions of most of the worlds military firearms.
For full-auto weapons you must apply for a class III Federal Firearms License which is nearly impossible to get now.
ASSAULT RIFLE is an anti-gun euphemism designed to make semi-automatic rifles sound Evil in their own right.
A weapon is a tool that is only as dangerous as it’s operator(just like a car). Have fun, be safe and enjoy/promote the shooting sports that are a part of your American Birth Right!!!

    "Assault rifle" as in…

I can excuse ignorance of the subject, its rather common here being a public forum and all. If your speaking of machine guns yes but they are heavily regulated. Read the national firarms acts of 1938, 1968, and 1986 because it will help you better understand. Machine guns can only be owned if they were made 1986 or earlier. Thats the cutoff date for us civilians. And guns that you do get are registered with the ATF, you need to pay a $200 tax stamp to them and there is a 3 month waiting period. Plus the guns themselves go for tens of thousands of dollars. The MP-5 was designed and produced before 1986 so you can get one. Finding and paying for one is the issue here. So, good frikkin luck. And since H&K hates us you can get semi-auto but importation of the semi-auto variant, the HK94 hasn’t been imported since 1989 so even they are rare and also restricted to the same delegation as machine guns due to the short barrel.

If your speaking of semi-auto you can go into the store and leave same day with just filling out one sheet of paperwork. But that can vary by state. So your only real option is to go for something else in semi-auto. A lot of people think machine guns are easily bought, this is not the case and we can thank the brady’s, the media and democrats for that.

So in a nutshell if your looking for an MP-5 or anything that looks like an MP-5 your fucked. Were not that free anymore.

The term "assault rifle" is really misused by most people and ESPECIALLY by the news folks. The BATFE (Bureau of Alcohol, Tobacco, Firearms and Explosives (4 things that should never go together)) is the authority in the US, and they do have an official definition. That definition has many elements, but the KEY one is this:

An assault rifle must be capable of select fire or full-auto fire.

When you hear people talking about gun control and banning assault rifles, what they are REALLY talking about is banning rifles that suffer from a cosmetic similarity to a true assault rifle. An AR-15, for example, is not and can never be an assault rifle. Yet, with the now-expired Clinton Assault Weapon Ban, the AR-15 was prohibited.

    But I digress.

In 34 states, it is legal to own assault rifles. If you are 21, have the proper BATFE tax stamp ($200), and can find one. That last element is the tricky part.

Fully automatic guns used to be legal. Then lawmakers started tightening down on things. The real kicker, though, came in 1986, when the Feds prohibited the sales of newly-manufactured automatic guns to civilians. This meant that the only automatic guns that could legally be sold now were those that were registered with the BATF before the passage of that law.

The NEWEST gun you could POSSIBLY buy legally was made 33 years ago. It’s probably been owned by a dozen people and had hundreds of thousands of rounds through it. You would throw it away as junk except for the fact that there are no new ones coming into the market. So, while it’s yours, you do whatever you can to keep it running. And when you sell it, you can expect to get a fortune.

Assault rifle is a maligned term used by the anti gun faction to mean ANY military look alike rifle, whether they are semi-auto or full auto. A true assault rifle is always capable of selective fire. Yes, the semi-auto one are allowed in most states, but they nevertheless are still demonized.

Real assault rifles, capable of full auto fire, require a long drawn out procedure and payment of a hefty transfer tax.

Assault rifle lookalikes, what the media and politicians call and assault rifle, are in reality just another semi-auto rifle based on a military design, so you only have to go through the standard background checks and such.

Either way, I think you have to be 21 and some states don’t allow the purchase of assault rifle lookalikes. In some states some of the lookalikes are totally outlawed but if you have connections, the real thing is still legal.

It makes no sense, but gun laws rarely do. Check with a local gun shop. They have to deal with the legal requirements and would have the most up to date info for your state.

Assault Rifle is a Clinton ,Brady made up term. MP5′s can’t be sold to the public new.You cannot BUY any machine gun new unless it or receiver was registered prior to 1986. If you have proper blessing and fees from the ATF you can buy a used one if you find one for 20,000.00+

  9. CactiJoe

If you are 21 and have about $25,000 you can buy an MP-5, a real MP-5 if you can find one from a Class 3 dealer. There are better 9mm carbines out there for less money.

    Good Luck!!

Semi-auto is no problem unless you live in one of the commie strongholds like NYC or Chicago et al.

You can get a semi-auto copy of one with a long barrel (over 18inches). It would be considered an "assault WEAPON" according to the morons in congress but you can still own it. To get an actual assault rifle, you have to be 21, pay a $200 tax stamp and wait about 6 months for the paperwork to go through allowing you to buy one. Then you have to get your local police chief to sign off allowing you to own one. All this after finding a class 3 FFL dealer. The going price on an actual MP-5 is about $20,000 so good luck.

  12. OkieRoadhunter

Well, I’d say 8 people lecturing you about terminology and Class III licenses is enough.
You can buy a semi-automatic "assault type rifle" in most states in the USA with only a background check, and at the age of 18.
I’d look for an M4 from Rock River or DPMS.
